3 guilty pleas are entered

Québec, July 20, 2010 – Marcel Blanchet, Chief Electoral Officer, wishes to inform the public that 3 guilty pleas were entered in cases involving violations of An Act respecting elections and referendums in municipalities (AERM).

Drummondville
 
In Drummondville, Mr. Pierre Derouin, while running as an independent candidate in the November 1, 2009 municipal elections and while acting as his own official agent and representative, neglected to send the treasurer of the municipality, not later than January 30, 2010, his return of election expenses and his financial report pursuant to sections 484 and 492 of An Act respecting elections and referendums in municipalities.
 
On May 31st of this year, Mr. Derouin entered a guilty plea in response to the charge brought against him. He also paid a fine of $250, plus expenses.
 
Saint-Félix-de-Valois
 
In Saint-Félix-de-Valois, following the withdrawal of the authorization of the Action St-Félix party on October 21, 2009, Mr. Patrice Rousseau and Ms. Lisette Falker, who respectively were acting as official representative and party leader, neglected to send the Chief Electoral Officer, not later than March 17, 2010, the documents related to the party’s finances listed in section 408 of An Act respecting elections and referendums in municipalities (AERM).
 
Mr. Rousseau and Ms. Falker thereby committed an offence in application of section 638 of the AERM. Indeed, under section 638, when a party commits an offence, the persons mentioned in this provision, such as the leader and the official representative of the party, may have legal proceedings instituted against them and be found guilty.
 
On June 16th of this year, the two individuals submitted a guilty plea to the Chief Electoral Officer with respect to the charge brought against them. They also paid the fine of $500 each, plus expenses.
